The QBCC Pool Safety Register is mandatory for all Queensland pools. We walk you through the three-step check to ensure you are compliant and avoid potential legal penalties.
The Mandatory Register
If you own a swimming pool or spa in Queensland, you are legally required to have it registered on the state’s official database. This isn’t just an optional administrative step; it’s mandatory under the Building Act 1975.
This database, managed by the Queensland Building and Construction Commission (QBCC), is called the QBCC Pool Safety Register. Its primary purpose is to ensure all pools have the correct certification to reduce safety risks.
An unregistered pool is a huge headache waiting to happen. It can attract significant financial penalties from local council and, crucially, you cannot obtain a legally valid Pool Safety Certificate (Form 23) until the registration is complete.
Step-by-Step: How to Check if Your Pool is Registered
Checking your registration status is quick, free, and should be the first thing any Queensland homeowner or property manager does.
Step 1: Visit the QBCC Pool Safety Register Website
Start by heading straight to the official online register.
Official Link: https://my.qbcc.qld.gov.au/s/pool-register
Step 2: Search by Property Address
You will be prompted to enter your full property address. Make sure to use the exact address details as recorded on your property title to ensure the most accurate search results.
Step 3: Review Pool Information
Once you submit the search, the system will display any pools associated with that address. Look carefully at the results:
- Does your pool appear in the list?
- If it appears, does it show a current Pool Safety Certificate attached to the registration?
If your property address pulls up no results, or the information is inaccurate, you need to take action.
What to Do If Your Pool Isn’t Registered
The good news is that if your pool is missing from the register, you can quickly and easily register it yourself online.
The registration process is entirely free of charge for pool owners and can be done through the same QBCC website. You’ll need a few basic details ready:
- Your full address and property owner information.
- Details about the pool, such as whether it’s an in-ground or above-ground structure.
- The date it was built or installed.
A critical note on pool type: Remember, the requirement to register applies to all pools and spas capable of holding water to a depth of more than 300mm. This includes temporary, demountable, and inflatable pools, as well as regular hot tubs and spas. If it holds water above that depth, it must be registered.
How to De-Register a Pool
If you have lawfully decommissioned or removed a pool, you must also remove its record from the QBCC register. This is done via a written request.
To remove a pool from the register, send an email to [email protected]. Once your pool record is removed, you will receive a confirmation email.
Important Compliance Note: In addition to removing your pool from the register, a pool must lawfully be decommissioned, which may require building approval. Before commencing any work for the removal or decommissioning of a pool, check with your local council for specific requirements on how to do this.
How to Update or Correct Pool Details
If you have recently purchased a property with a pool, the ownership details may need to be updated. Similarly, if you’ve undertaken major work that changed the pool’s structure or location, the register might need correction.
Owners can log into the QBCC online portal to update property contact details, transfer ownership, or correct any errors on the pool listing. Keeping these details current is essential, especially when you are selling, leasing, or applying for new compliance certificates.
Why Registration Matters
While avoiding a fine is a great motivator, the importance of registration goes much deeper.
- Safety and Certification: Registration is a prerequisite for having your pool inspected and certified by a licensed Pool Safety Certifier.
- Protection During Sale & Lease: A valid registration and certificate are non-negotiable when selling your home or signing a new lease agreement. It protects you from costly delays, contract complications, and legal claims from buyers or tenants regarding non-compliance.
- Peace of Mind: Knowing your property is legally compliant is an essential part of responsible home ownership across Brisbane, the Gold Coast, and the Sunshine Coast.
