NSW Pool Compliance Inspections

All properties in New South Wales are required by law to have a pool compliance certificate, but this isn’t the only reason for getting a safety inspection.

Selling a Property with a Pool

As of the 29th of April 2015, shared pools and anyone selling or leasing their house with a pool need to have a valid pool compliance certificate.

 

After the Inspection

Once you have your pool compliance certificate, you can register your pool yourself on the NSW Government Pool Register.

 

NSW Swimming Pool Regulation Checklist

Your pool fencing should be properly constructed and must follow the swimming pool regulation in NSW

The relevant legislation can be found here:

Swimming pools must be surrounded by a Child Resistant Barrier. It is the pool owner’s responsibility to ensure the swimming pool barrier is in good repair and good working conditio.

To be compliant, your pool area needs to meet the following safety criteria:

❖ Pool fences

  • The height the pool fence must be at least 1200mm
  • The gap between the bottom of the fence and the ground is not more than 100mm
  • Horizontal rails no closer than 900mm apart  
  • Vertical rails no greater than 100mm apart
  • No climbable objects within 900mm from the outside and 300mm from the inside  

❖  Signage

  • There should be CPR sign that is visible to anyone near the pool

❖ Doors and windows

  • No doors provide direct access from the house to the pool area              
  • Windows which open onto the pool area are fixed so that they do not open more than 100mm or they have a security screen fitted          

❖ Gates

  • The pool gate opens away from the pool  
  • The gate self-closes and self-latches from all open positions
  • The gate latch is at least 1500mm off the ground and 1400mm above the top part of the lower horizontal railings.

Frequently Asked Questions

What if my pool doesn't pass the pool safety inspection?

A full report will be sent to you as to what needs to be fixed along with any diagrams that are applicable.

If our inspector deems that the property is a public safety hazard, our inspectors are required to alert the council immediately.

From the date you received the report you have a period of six weeks to attend to the noncompliant items. If by the end of the six week period the non-compliant items have not been resolved then by law we must send a copy of the non-compliance notice to the council.

What is the fine for not having a fence around your pool?

On the spot fines of $550 can be issued.

Penalties for non compliance with pool safety regulations can be $5500 in some cases.

Do you have to register your pool in NSW?

Swimming pools must be registered.

Pool owners can do this online by completing the NSW Swimming Pool Registration Form.

If you prefer, you can pay a fee to your local council and they will register it on your behalf.

How long does a pool safety certificate last?

If your property is in New South Wales and is a single/multiple dwelling property, your pool compliance certificate is valid for 3 years.

If you are leasing out your property, your certificate will be valid for 3 years no matter how many times your tenants change.

Can you sell a house without a pool safety certificate in NSW?

It is now law that a property being sold with a pool or spa must:

  • Be registered (you can register your pool online here.)
  • Have a valid certificate of Compliance or a Certificate of Non Compliance in the Contract of Sale.

In order to put your property on the market, you MUST have the pool or spa inspected by a licenced pool inspector.

Without a valid pool safety certificate (pool compliance certificate), the Contract for Sale cannot be issued to the real esate agent and the property cannot be sold.
