Not so fast!<\/strong><\/h3>\n<p>Before you put any additional dwelling on your residential property such as a garage, shed or carport, it is important to understand and comply with both state and local council requirements.<\/p>\n<p>Finding out whether or not you need to obtain a building approval before you start your project can save you thousands in hefty council fines. Building a shed without a permit can cost up $44,000.<\/p>\n<p>In this article, we look at the key factors that determine whether or not you require a building approval and when you need to enlist a private certifier.<\/p>\n<h2>What is a building permit and do you need one?<\/h2>\n<p>A building permit or approval is issued by your local council or a <a href=\"https:\/\/www.icertified.com.au\/building-approvals.html\">private building certifier<\/a> to homeowners and property developers, after proper inspection of building plans and construction sites has been completed. It indicates that the project meets the regulations defined by the <a href=\"https:\/\/ncc.abcb.gov.au\/editions-national-construction-code\" target=\"_blank\" rel=\"noopener\">Building Code of Australia<\/a>.<\/p>\n<p>Different states have different rules and regulations regarding building approvals. According to <a href=\"https:\/\/www.legislation.qld.gov.au\/view\/html\/inforce\/current\/sl-2021-0126\">Queensland Building Regulation 2021<\/a>, some smaller types of building work do not need approval. The owner is subsequently responsible for ensuring the work is compliant with state and local standards instead.<\/p>\n<h3><strong>These types of structures include:<\/strong><\/h3>\n<ul>\n<li>small tool sheds, stable or similar up to 10m<sup>2<\/sup>, other than in a tropical cyclone area<\/li>\n<li>a 1m high <a href=\"https:\/\/www.icertified.com.au\/news\/retaining-walls-when-is-building-approval-required\/\">retaining wall<\/a> (if no loads are imposed above it, such as a building or driveway)<\/li>\n<li>a fence no more than 2m high (not including swimming pool fencing).<\/li>\n<\/ul>\n<p>If you are unsure whether your intended building falls under the category of <em>accepted development<\/em> (previously called self-assessable) or not, you are best to check with your council. Provide them with details of your plans and they can guide you in the right direction. However, even smaller buildings will need approval if they are intended in any of Queensland\u2019s cyclonic areas. Regions including Cairns, Townsville, Mackay, and the Whitsundays are all classified as cyclonic regions and will require a building approval. Again, if you\u2019re unsure whether you are located in a cyclonic area or not, <a href=\"https:\/\/www.getready.qld.gov.au\/find-your-local-council\" target=\"_blank\" rel=\"noopener\">check with your local council<\/a> or a with a private Building Certifier, like iCertified.<\/p>\n<p>You can also arrange for a building approval through your Building Certifier.
