NSW Pool Safety Certificate Glossary

There can be a lot of legal terms when we talk about pool safety certificates, compliance and registration. For your benefit we’ve put together a short glossary and explanation of the more common pool safety compliance terminology.

Accredited certifier – An accredited certifier is a category A1, A2, A3 or E1 accredited certifier, registered with the NSW Building Professionals Board.

Certificate of compliance – A certificate of compliance is evidence that a swimming pool meets the requirements of the NSW Swimming Pools Act 1992 and the NSW Swimming Pools Regulation 2008. A certificate of compliance is issued from the NSW Swimming Pool Register.

Certificate of non-compliance – A certificate of non-compliance is evidence that a swimming pool does not meet the requirements of the NSW Swimming Pools Act 1992 and the NSW Swimming Pools Regulation 2008. A certificate of non-compliance is issued from the NSW Swimming Pool Register.

Certificate of registration – A certificate of registration is evidence that a swimming pool is registered on the NSW Swimming Pool Register.  A certificate of registration is generated by the NSW Swimming Pool Register.

Lease – A lease is a residential tenancy agreement, as defined in the NSW Residential Tenancies Act 2010.

Local authority – A local authority is a NSW local council.

Relevant occupation certificate – A relevant occupation certificate is an occupation certificate issued under the NSW Environmental Planning and Assessment Act 1979 that is less than three years old and that authorises the use of the swimming pool.
